FACEBOOK: COMPLAINT FILED TO THE EUROPEAN COMMISION FOR NON COMPLIANCE WITH EU LAW

The complaint was filed in writing and was emailed to the European Commission Representation in Athens to the email address comm-rep-athens@ec.europa.eu

Breach of privacy on part of the company “FACEBOOK Ireland Limited”, with which EU facebook users are counterparties, based in Ireland's capital, Dublin (Benson Str.), which is a subsidiary company of "Facebook Ink" based in Menlo Park campus of California State University, USA.

Violation on part of Ireland or/and Greece by breach of its/their obligations derived from EU law, and particularly the obligation to effectively implement the European Council Convention of 1981 and Directive 95/46/EC on the protection of individuals with regard to the processing of personal data, and the Directive 2002/58/EC concerning the processing of data personal data and the protection of privacy in the electronic communications sector (Directive on "privacy and electronic Communications").

Failure to adopt and implement effective regulations and administrative provisions relating to the transfer of these Directives into domestic law, and to address practices of serious breaches of privacy by the company "FACEBOOK Ireland Limited" namely, the introduction to the aforementioned social network of the following functions:

I. The 'Time Stamp' on iPhone's Mobile App, provides without your consent information to your facebook friends about your last online facebook connection ('Last Active') when accessing facebook from a mobile device (sceenshot here).
